Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ZIVOXA — the website, apps, and related services (the “Service”). By registering or using ZIVOXA you agree to these Terms, our Privacy Policy, Community Guidelines, and (if you are a Creator using paid listing or monetize features) our Creator Terms.

1. Agreement

If you use ZIVOXA on behalf of a company, you represent that you have authority to bind that entity, and “you” includes that entity.

2. Eligibility

  • You must be at least 18 years old.
  • You must provide accurate registration information.
  • You must not be prohibited from using online marketplaces under applicable Indian law.

3. Accounts & security

  • Keep credentials confidential. You are responsible for activity under your account.
  • Notify us promptly of unauthorised access.
  • One person/entity should not create multiple accounts to evade bans, fees, or limits.
  • We may require email or phone verification and may suspend accounts that fail checks.

4. Roles on ZIVOXA

Business users

Businesses may browse creators, filter by niche/city/platform, save profiles, message creators (subject to product rules), and leave ratings where enabled.

Creators

Creators may build a profile, apply for approval, pay listing fees where required to appear publicly, request boosts/featured placement, chat with businesses, and apply for monetize / payout features subject to Creator Terms.

5. Marketplace & listings

  • Public discovery generally requires Creators to be approved and to maintain an active paid listing where the product requires it.
  • Featured / boost placements may be granted after request and/or payment and admin review. Placement is not guaranteed permanently.
  • Search and home feeds may be ranked using relevance, location, category affinity, quality signals, and paid promotion — see product behaviour; ranking is not a guarantee of leads.
  • ZIVOXA may edit, refuse, or remove profiles that violate these Terms or Community Guidelines.

6. Chat & conduct

  • Use messaging for lawful collaboration discussions.
  • No harassment, spam, scams, sexual solicitation involving minors, or illegal offers.
  • Do not scrape, bulk-export, or misuse contact details unlocked through the Service.
  • Official ZIVOXA accounts may send broadcasts; replies may be disabled on those threads.

7. Your content & licence

You retain ownership of content you upload (photos, bio, portfolio, messages). You grant ZIVOXA a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content as needed to operate and promote the Service (including public marketplace pages and app stores screenshots of public UI where applicable).

You represent you have rights to the content and that it does not infringe others’ IP, privacy, or publicity rights.

8. Platform fees

Certain features require payment (e.g. annual listing, boosts). Fees are shown in-app before checkout and are processed by third-party gateways. Refunds are governed by our Refund Policy. Taxes may apply as required by law.

9. Brand–creator collaborations

ZIVOXA is a discovery and messaging platform. Unless we expressly state otherwise in writing, we are not a party to commercial agreements between brands and creators. Deliverables, payment for campaigns, timelines, and dispute resolution between those parties are their responsibility. Ratings and reports help the community but do not make ZIVOXA a guarantor of performance.

10. Prohibited uses

You must not:

  • Violate law, including advertising, consumer, IP, or data-protection rules
  • Impersonate others or misrepresent metrics, identity, or brand affiliation
  • Upload malware, attempt unauthorised access, or disrupt the Service
  • Use bots/scrapers against private APIs or to harvest user data
  • Post adult, hateful, or violent content contrary to Community Guidelines
  • Facilitate fraud, pyramid schemes, or prohibited goods/services

11. Moderation & enforcement

We may investigate reports, remove content, limit features, or suspend/terminate accounts that violate these Terms. We may preserve data where needed for safety or legal compliance.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted uptime, uninterrupted leads, or accuracy of user-provided follower counts or portfolio claims.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIVOXA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) FEES YOU PAID TO ZIVOXA FOR THE SERVICE IN THAT PERIOD OR (B) INR 5,000.

Nothing in these Terms excludes liability that cannot be limited under applicable law.

14. Termination

You may stop using the Service and request account deletion under our Account Deletion Policy. We may suspend or terminate access for breach, risk, prolonged inactivity, or legal reasons. Sections that by nature should survive (licence for content already displayed, payment obligations, disclaimers, liability limits) will survive termination.

15. Governing law & disputes

These Terms are governed by the laws of India. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
